The city of Lakeland may finally be getting a cell tower after two denials over the past year. <\/p>\n\n\n\n

The tower in question is taller than those previously proposed but is also in a much more agreeable area, according to city staff. The city did not receive any messages in opposition to the tower and no residents spoke during public comment at the Lakeland Planning and Zoning Board meeting Tuesday morning. <\/p>\n\n\n\n

Principal Planner Phillip Scearce said in his presentation to the board that the location of the tower is one “I think we can all agree with.” <\/p>\n\n\n\n

“Compared to the last tower sites, I think there’s really not much opposition here,” Scearce said. “The only thing out there is cattle.” <\/p>\n\n\n\n

The board unanimously approved a conditional use permit for the construction of a 180-foot-high unipole tower on 24 acres east of Lakeland Highlands Road and north of the Polk Parkway, just east of the Sam’s Club. The tower’s unipole design, a condition of the board’s approval, will see all antennas internally mounted and contained within the cell tower structure. <\/p>\n\n\n\n

The tower, which if built can accommodate up to five providers, was proposed by Gulfstream Towers LLC to solve a “significant gap” in coverage for AT&T and Verizon Wireless. <\/p>\n\n\n\n

The conditional use permit was needed to override the 150-foot building height limit on properties zoned for limited development. City staff recommended approval. <\/p>\n\n\n\n

If approved by the Lakeland City Commission, this tower will become successful where two others failed. The commission denied one cell tower in December and upheld the Planning and Zoning Board’s denial of another tower in April.<\/p>\n\n\n\n

In both cases, the applicants sued the city over those denials, alleging violations of the Federal Telecommunications Act of 1996. The city has already won one lawsuit brought forward by North American Towers LLC for the denial of a cell tower on Ariana Street. The second lawsuit filed by 1 Source Towers LLC is still pending; the last motion in the suit was filed in mid-July. <\/p>\n","protected":false},"excerpt":{"rendered":"
