{"id":36839,"date":"2023-10-05T20:48:24","date_gmt":"2023-10-06T00:48:24","guid":{"rendered":"https:\/\/lakelandgazette.info\/news\/?p=36839"},"modified":"2023-10-05T20:48:33","modified_gmt":"2023-10-06T00:48:33","slug":"judge-sets-bond-at-250000-for-driver-accused-in-fatal-hit-and-run-death-of-polk-county-boy","status":"publish","type":"post","link":"https:\/\/lakelandgazette.info\/news\/2023\/10\/05\/judge-sets-bond-at-250000-for-driver-accused-in-fatal-hit-and-run-death-of-polk-county-boy\/","title":{"rendered":"Judge sets bond at $250,000 for driver accused in fatal hit-and-run death of Polk County boy"},"content":{"rendered":"\n<p class=\"wp-block-paragraph\">The man accused in the\u00a0death of a 9-year-old Polk County boy\u00a0learned Thursday his bond would be elevated.<\/p>\n\n\n<div class=\"wp-block-image\">\n<figure class=\"aligncenter size-full is-resized\"><img loading=\"lazy\" decoding=\"async\" sizes=\"auto, (max-width: 414px) 100vw, 414px\" src=\"https:\/\/lakelandgazette.info\/news\/wp-content\/uploads\/2023\/10\/ALMAGUER-GILBERT-LEE.jpeg\" alt=\"\" class=\"wp-image-36840\" style=\"width:209px;height:258px\" width=\"209\" height=\"258\" srcset=\"https:\/\/lakelandgazette.info\/news\/wp-content\/uploads\/2023\/10\/ALMAGUER-GILBERT-LEE.jpeg 414w, https:\/\/lakelandgazette.info\/news\/wp-content\/uploads\/2023\/10\/ALMAGUER-GILBERT-LEE-243x300.jpeg 243w\" \/><\/figure>\n<\/div>\n\n\n<p class=\"wp-block-paragraph\">\u201cMy bond\u2019s been paid since Sunday,\u201d Gilbert Almaguer said to Judge Kevin Kohl.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cI just set a bond,\u201d Kohl said.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Almaguer\u2019s arrest warrant showed a $15,000 bond with \u201cno bond at first appearance\u201d listed as a condition of release.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">At Almaguer\u2019s first appearance hearing Thursday, Judge Kohl set the bond at $250,000 after the prosecutor requested an elevated bond.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Almaguer, 45, of Bowling Green, is accused of leaving the scene of a crash involving death.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">On Friday evening, according to the Polk County Sheriff\u2019s Office, Almaguer hit Andres Martinez, 9, of Fort Meade, with his truck on Hutchins Road and did not stop.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Martinez was riding his bicycle to his friend\u2019s house.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">According to his arrest affidavit, Almaguer contacted the Hardee County Sheriff\u2019s Office after seeing on Facebook that Martinez had died.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">At first,&nbsp;he told deputies he was the passenger&nbsp;in the truck before admitting he was the driver.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cHe stated that he was sorry and just got scared. He explained that the kid came out of<br>nowhere and he did not mean to hit him,\u201d his affidavit reads.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cHe turned himself in. A lot of people would try to avoid that situation so that\u2019s a big thing for us right there too,\u201d said Marisol Martinez, Andres\u2019 sister. \u201cEverybody makes mistakes.
