Ileana Garcia, R-Miami, proposes an amendment to the Florida Constitution, outlawing government-run \u201ctraffic infraction detectors\u201d in nearly all cases.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">It applies to the detectors operated either by the state or its \u201cpolitical subdivisions.\u201d<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">However, it still allows the use of such detectors in school speed zone road sections.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Below is the proposed wording for Section 33, Article X of the Florida Constitution:<\/p>\n\n\n\n<div class=\"wp-block-group\"><div class=\"wp-block-group__inner-container is-layout-constrained wp-block-group-is-layout-constrained\">\n<div class=\"wp-block-group\"><div class=\"wp-block-group__inner-container is-layout-constrained wp-block-group-is-layout-constrained\">\n<p class=\"has-vivid-red-color has-text-color has-link-color wp-elements-1 wp-block-paragraph\">Prohibition on traffic infraction detectors. \u2013 The state or a political subdivision thereof is prohibited from placing and operating traffic infraction detectors used for the purpose of detecting when a driver of a motor vehicle fails to stop at a traffic signal. This prohibition does not apply to the placement and operation of traffic infraction detectors on portions of roadways established as school speed zones.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><a href=\"https:\/\/www.flsenate.gov\/Session\/Bill\/2024\/1042\/BillText\/Filed\/PDF\">SJR 1042<\/a><\/p>\n<\/div><\/div>\n<\/div><\/div>\n\n\n\n<p class=\"wp-block-paragraph\">Red light cameras are\u00a0<a href=\"https:\/\/communitylawfirm.com\/new-florida-red-light-camera-law-changes#:~:text=Red%20light%20cameras%20are%20in,%2C%20and%20Miami%2DDade%20counties.\">mostly used<\/a>\u00a0in Florida\u2019s major urban or\u00a0<a href=\"https:\/\/www.photoenforced.com\/florida.html\">high population-density<\/a> areas, including Palm Beach, Broward, and Miami-Dade County. There are also red light cameras in the Lakeland.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">They are rarer in Southwest Florida and the northern half of the state, including major cities Jacksonville and the state\u2019s capital, Tallahassee.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">According to a 2022-released report by the&nbsp;<a href=\"https:\/\/www.flhsmv.gov\/pdf\/cabinetreports\/redlightcameraanalysis2022.pdf\">Florida Department of Highway Safety and Motor Vehicles<\/a>&nbsp;on the usage of traffic light cameras, there are just under 500 red light cameras statewide.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">During fiscal year 2021-2022, the report found that authorities issued nearly a million red light traffic violations. However, that number is down from a peak of over 1.2 million in 2015-2016 despite Florida\u2019s growing population.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">To be passed, the resolution must be approved with a&nbsp;<a href=\"https:\/\/www.flsenate.gov\/Reference\/Glossary#hjrsjr\">three-fifths vote<\/a>&nbsp;by the Florida House of Representatives and Senate.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">From there, the amendment wording would appear on Florida voters\u2019 ballots in the coming November election, requiring 60% for full approval.
