More than 30 Florida laws will go into effect on Oct. 1.<\/p>\n\n\n\n

While many of the bills from the last legislative session that were signed into law by Gov. Ron DeSantis went into effect in July, dozens will go into effect Oct. 1. Notable bills are listed below, with a full list at the bottom.<\/p>\n\n\n

No sleeping in public ( HB 1365 <\/a>)<\/p>\n\n\n\n

The most controversial law of the bunch is one that effectively bans homeless people from sleeping in public. The law also promises more resources for those who are homeless, but critics are skeptical.<\/p>\n\n\n\n

Counties will be allowed to designate certain areas for camping when shelters become full, but only with approval from the Department of Children and Families, and for a period of one year.<\/p>\n\n\n\n

Supporters of the bill say it will be easier to provide services to the homeless if they\u2019re all in one place, but critics say the bill does nothing but gather up the homeless and move them out of public sight.<\/p>\n\n\n\n

\u201cThis bill does not and it will not address the more pressing and root cause of homelessness,\u201d said Democratic state Sen. Shevrin Jones during a debate this year. \u201cWe are literally reshuffling the visibility of unhoused individuals with no exit strategy for people who are experiencing homelessness.\u201d<\/p>\n\n\n\n

DeSantis, however, said the new law is a unique approach in pledging to provide the services that homeless people often need.<\/p>\n\n\n\n

\u201cThis is going to require that the services are there to help people get back on their feet,\u201d the governor said. \u201cI think it\u2019s important that we maintain the quality of life for the citizens of Florida.\u201d<\/p>\n\n\n\n

The ban does not apply to people sleeping in vehicles that are legally parked.<\/p>\n\n\n\n

The law is allowed to take effect after the U.S. Supreme Court ruled in June that governments can implement public sleeping bans.<\/p>\n\n\n\n

Designation of a Diagnosis on Motor Vehicle Registrations ( HB 341 <\/a>)<\/p>\n\n\n\n

This law allows a vehicle registration applicant \u2014 or parent or guardian of a child \u2014 who has a disability or condition diagnosed by a licensed physician to voluntarily disclose that on their motor vehicle record.<\/p>\n\n\n\n

The department of motor vehicle record must designate \u201cSAFE\u201d (Safeguarding American Families Everywhere) and may not include personal identifying information or information on the specific diagnosis.<\/p>\n\n\n\n

The law provides law enforcement and first responders with an advanced notice that the person they\u2019re going to interact with has a disability or condition in hopes of reducing \u201cunnecessary adverse actions,\u201d improving communication, and getting the person-specific care that\u2019s needed.<\/p>\n\n\n\n

\u201cInteracting with law enforcement officers or first responders in an emergency, such as a motor vehicle crash or other crisis situation, can be more complex for persons with special needs, as language, physical, cognitive, learning, or mental disabilities may create barriers to receiving immediate and appropriate assistance,\u201d the bill reads.<\/p>\n\n\n\n

Some of the conditions include autism, ADHD, Down syndrome, Alzheimer\u2019s, PTSD, a traumatic brain injury, diabetes, deafness, blindness, or another \u201cmentally or physically limiting disorder,\u201d according to the bill\u2019s text.<\/p>\n\n\n\n

Applicants can update the record at any time to add or remove the designation.<\/p>\n\n\n\n

Increased penalties for retail theft ( HB 549 <\/a>)<\/p>\n\n\n\n

HB 549 increases penalties for retail theft and porch pirates. The law makes it a third-degree felony to commit retail theft with more than five people. It also makes it a second-degree felony to commit retail theft with five or more people and use social media to encourage others to participate.<\/p>\n\n\n\n

The law also allows for a person to be charged with a felony for retail theft if they commit multiple thefts in a 120-day period, which is an increase from the 30-day period.<\/p>\n\n\n\n

\u201cFlorida is taking another step to distinguish ourselves from lawless jurisdictions and keep our residents and businesses safe,\u201d DeSantis said in a statement upon signing the bill in April. \u201cIf you steal in Florida, we will catch you and we will prosecute you.\u201d<\/p>\n\n\n\n

Penalties for porch pirates also increase under HB 549.<\/p>\n\n\n\n

Exposing first responders to fentanyl ( SB 718 <\/a>)<\/p>\n\n\n\n

This law adds penalties for those whose behavior \u201crecklessly\u201d exposes first responders to fentanyl, leading to an overdose or other injury.<\/p>\n\n\n\n

Anyone over 18 who causes a first responder to overdose or be injured due to fentanyl exposure will be committing a second-degree felony.<\/p>\n\n\n\n

Flood disclosures ( HB 1049 <\/a>)<\/p>\n\n\n\n

This law requires the seller of a property to complete and provide a flood disclosure to the purchaser at or before the contract is executed.<\/p>\n\n\n\n

The disclosure will specify whether or not the seller has filed an insurance claim related to flood damage for that property or has ever received federal assistance for flood damage. It also includes an encouragement for the buyer to consider whether they need to purchase flood insurance.<\/p>\n\n\n\n

Increased penalties for defrauding certain groups ( HB 1171 <\/a>)<\/p>\n\n\n\n

This law increases penalties for anyone who commits a \u201cscheme to defraud\u201d a person if the victim is over the age of 65, a minor, or has a mental or physical disability.<\/p>\n\n\n\n

The law also includes the ability for a person to file a civil action if their name, image, or likeness is used in a scheme to defraud without their consent.<\/p>\n\n\n\n
