(Section 4-27 of the Polk County Code references dogs but does not mention cats.)<\/li>\n\n\n\n<li>Does any ordinance prohibit or restrict the feeding of outdoor cats?<\/li>\n\n\n\n<li>If such ordinances exist, please provide specific code section references.<\/li>\n\n\n\n<li>If no such ordinances exist, what legal authority empowers Animal Control officers to issue these directives?<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">Directives instructing residen<strong>ts to cease feeding outdoor cats without legal authority may constitute overreach and could result in violations of Florida Statute 828.12 (animal cruelty) if animals are deliberately starved.<\/strong><\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>Issue 2: Municipal Variations in Ownership via Feeding\/Harboring<\/strong><br>Some municipalities within Polk County assign ownership based on feeding or harboring animals for a set period:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>Polk City: Ownership established after 3 consecutive days of harboring, feeding, or maintaining<\/li>\n\n\n\n<li>Winter Haven: Ownership established through feeding or sheltering for 3+ consecutive days<\/li>\n\n\n\n<li>Mulberry (Section 5-18): Custodianship established after 7+ days of harboring, feeding, or maintaining<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\">Municipalities without similar provisions include Lakeland, Haines City, Auburndale, Bartow, Lake Wales, and the Town of Lake Hamilton.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Questions:<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>For municipalities lacking ownership-through-feeding provisions, should Animal Control be precluded from:\n<ul class=\"wp-block-list\">\n<li>Declaring cat feeders as owners?<\/li>\n\n\n\n<li>Imposing vaccination requirements on feeders for unowned animals (Section 4-24, Polk County Code)?<\/li>\n\n\n\n<li>Holding feeders liable under nuisance ordinances for animals they do not legally own or control (Section 4-31, Polk County Code)?<\/li>\n<\/ul>\n<\/li>\n<\/ul>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>Evidentiary Standards Concern<\/strong><br>The current complaint process relies on single-complainant report or single sworn statement without corroborating evidence, even for owned pets.
