Letter to the Editor – Questions for Commission Candidate John Hall

In 2018 Mr. Hall was a Polk County Commissioner, owner of a community management company employed by the developer of Morgan Creek Preserve, and a board member of the community HOA. He executed a quit claim deed that conveyed Tract F of Morgan Creek back to the developer, Landstar Lakeland. This was done without the knowledge of the residents, without a meeting and vote and without a joinder required in the covenants. This land had been owned by the HOA for 13 years and contained all the amenities of the community.

Mr. Hall represented the developer at the Planning and Zoning meeting and the City Commissioners meeting in the developer’s attempt to build eight more homes on this land. The community defeated the developer who then leased back our pool and other amenities for over $50K per year. He also converted the men’s changing room of the pool house into an office that became the principal address for a maintenance company owned by Mr. Hall.

Florida Statute 720.303.1 states that HOA board members have a fiduciary responsibility to the members. My question to Hall is how does the questionable transfer of land and its subsequent for-profit use in a residential area comply with your requirement to put the interests of this community ahead of your own?
