Olivia Pollock, a Polk County resident charged with crimes related to the U.S. Capitol attack, has joined a motion by her younger brother to have some counts dismissed.
A lawyer for Olivia Pollock filed a motion Monday to adopt Jonathan Pollock’s two motions to remove some of the charges against her. Jonathan Pollock’s lawyer filed motions Sunday seeking to dismiss counts of civil disorder, arguing that the counts did not allege any specific acts.
The lawyer for Jonathan Pollock filed a second motion seeking to dismiss such charges as entering and remaining in a restricted area, arguing that prosecutors had charged him multiple times for the same offenses.
Olivia Pollock, 33, is charged with assaulting, resisting, or impeding officers outside the U.S. Capitol on Jan. 6, 2021, as well as entering or remaining in a restricted area, an act of physical violence on the Capitol grounds, and disorderly and disruptive conduct.
In a second filing, Olivia Pollock waived her right to a jury trial and requested a bench trial. That would give District Judge Carl J. Nichols of the District of Columbia the authority to determine the verdicts.
The Pollock siblings traveled with relatives and friends to Washington, D.C., to attend former President Donald Trump’s “Stop the Steal” rally on Jan. 6, 2021. They are not accused of entering the U.S. Capitol, but prosecutors say they joined rioters who pushed through police lines and approached the building as both houses of Congress were meeting to certify the 2020 presidential election results.
Olivia Pollock, who was free on bond after her arrest in Lakeland in June 2021, disabled a GPS device just before her scheduled trial last year and became a fugitive, the Department of Justice said. FBI agents captured Pollock, her brother, and their friend and fellow defendant, Joseph Hutchinson III, in January at a ranch in southern Lake County.
The Pollock siblings and Hutchinson are scheduled for trial on Oct. 15 . All have pleaded not guilty.
In a recent court filing, Jonathan Pollock’s lawyer indicated that both Pollocks are in discussions with prosecutors to resolve their cases before trial.
