• The proposed amendment would allow abortions up until fetal viability, around 24 weeks, and is currently polling at 70% approval among Floridians.
• The Florida Supreme Court must approve the measure before it can appear on the ballot, and it will need 60% approval to pass if it makes it to the 2024 ballot.
• GOP Attorney General Ashley Moody has challenged the amendment’s language as too vague and potentially allowing for “abortion on demand.”
• The amendment is a response to Florida’s six-week abortion ban and 15-week ban, with the latter currently in effect pending a state Supreme Court ruling on its constitutionality based on the state’s privacy clause. If the amendment passes, it would override these bans.
